1. About these terms
These terms apply to your use of tyrestack.com and the public demo of TyreStack (together, the "Site"), operated by Mediant Partners Ltd, trading as TyreStack, a company registered in Scotland (company number SC889184) whose registered office is 5 South Charlotte Street, Edinburgh, EH2 4AN, Scotland ("we", "us"). By using the Site you agree to them. If you do not agree, please do not use it.
The Site is intended for businesses, mainly mobile tyre fitters. Using TyreStack as a paying customer is covered by our separate Customer terms of service, which prevail over these terms for the service. Personal data is covered by our privacy notice.
2. Information on the Site
- The Site describes our service in general terms and is for information. It is not an offer capable of acceptance and does not form a contract; a contract is formed only when we agree an order form with you.
- The features, screens and example figures shown are illustrative. Product features and integrations may vary or change, and some depend on third-party services that you must connect through your own accounts.
- The demo uses invented records only. Do not enter real personal data, customer data or confidential information into it.
- We take care to keep the Site accurate and up to date, but we do not guarantee that it is complete or error-free. Nothing on the Site is professional, legal, tax or financial advice.
3. Acceptable use
You must not:
- use the Site unlawfully, or in a way that infringes anyone's rights;
- attempt to gain unauthorised access to the Site, our systems or other users' data, or probe, scan or test their vulnerabilities without our written permission;
- introduce malware, overload the Site, or use bots, scrapers or automated tools that interfere with it or copy it in bulk;
- copy, resell, or build a competing product from the Site's content or demo; or
- misrepresent your identity or your connection with us.
We may suspend or block access to the Site if we reasonably believe you have breached these terms.
4. Intellectual property
The Site, its design, text, graphics, code, screenshots and the TyreStack name and logo belong to us or our licensors and are protected by copyright and other intellectual property rights. You may view the Site and print or share a page for your own legitimate business purposes, provided you keep all notices intact. You may not otherwise reproduce, adapt or commercially exploit it without our prior written consent.
Third-party names and marks (such as WhatsApp, Meta, Google and others) belong to their owners and are used only to describe what TyreStack connects to. See the Legal notice.
5. Links and third-party services
The Site may link to other websites and services. We do not control them and are not responsible for their content, availability or practices. A link is not an endorsement.
6. Our liability
Nothing in these terms limits or excludes liability that cannot be limited or excluded by law, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other matter that cannot be excluded under the law of Scotland.
Subject to that, and because the Site is provided free of charge: the Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, so far as the law allows; we are not liable for loss arising from your use of, or inability to use, the Site, or from reliance on its content; and in particular we are not liable for loss of profit, revenue, business, goodwill or data, or for indirect or consequential loss. Our total liability to you in connection with the Site will not exceed £100. If you are a consumer, your statutory rights are not affected.
We do not guarantee that the Site will be uninterrupted or free from errors, viruses or other harmful components, and we may change, suspend or withdraw any part of it at any time.
7. Changes
We may change these terms from time to time by posting the new version here with a new date. Continued use of the Site after that means you accept the updated terms.
8. Governing law and courts
These terms, and any dispute or claim arising out of or in connection with them or the Site (including non-contractual disputes), are governed by the law of Scotland. The courts of Scotland have exclusive jurisdiction, except that if you are a consumer resident elsewhere in the United Kingdom you may also bring proceedings in the courts of the part of the UK where you live, and nothing here removes any mandatory consumer protection in your home jurisdiction.
